Terms and Conditions — Digital Products

These Terms and Conditions were last updated in April 2026. They apply to all digital products sold by ELOS Consulting. Please read them carefully before purchasing. By completing your purchase you confirm that you have read and agree to these Terms.

1. Definitions

In these Terms and Conditions:

• "Company", "I", "me", or "my" refers to Virginie Ferguson trading as ELOS Consulting, a sole trader registered in Scotland, operating at elosconsulting.co.uk. Contact: [email protected].

• "Customer", "you", or "your" refers to the individual purchasing a Product.

• "Product" refers to any digital product sold by ELOS Consulting, as described on the relevant sales or product page at the time of purchase.

• "Content" refers to all materials, resources, tools, prompts, copy, and other elements contained within or forming part of a Product.

• "Access" refers to your right to use a Product after purchase, via whichever platform or delivery method is specified at the time of sale.

2. The Products

ELOS Consulting sells digital products. These may include online toolkits, guided frameworks, templates, resource libraries, and similar digital goods. Each Product is described on its individual sales or product page.

Unless otherwise stated on the product page, upon purchase you receive:

• Immediate access to the Product and all Content included at the time of purchase.

• Any future updates or additions made to that Product, included as part of your original purchase.

All Products are delivered digitally. No physical goods will be dispatched.

3. Pricing and Payment

The price of each Product is as stated on the relevant sales or product page at the time of purchase. All prices are in GBP and inclusive of any applicable taxes unless otherwise stated.

Payment is required in full at the time of purchase. Access is granted automatically upon receipt of cleared payment.

I reserve the right to change the price of any Product at any time. Any price change will not affect purchases already completed.

4. Access and Account

Access to any Product is personal to you. You must not share your login credentials or grant access to any third party.

Unless otherwise stated on the product page, access is lifetime access from the date of purchase — there is no subscription, no renewal fee, and no expiry date, provided the delivery platform remains in operation.

I reserve the right to suspend or terminate access in the event of misuse, breach of these Terms, or conduct that is harmful to the integrity of a Product or to other users.

5. Cancellation and Refunds

Your right to cancel

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your purchase within 14 calendar days of the date of purchase, without giving any reason, and receive a full refund — unless you have already accessed the digital content and have waived your cancellation right (see below).

Waiver of cancellation right for digital content

All Products sold by ELOS Consulting are digital content delivered online. By completing your purchase, you expressly request immediate access to the Product and acknowledge that, by accessing the Content, you lose your statutory 14-day right to cancel.

This waiver is clearly presented at checkout. If you do not wish to waive this right, do not access the Product after purchase and contact me at [email protected] within 14 days to request a cancellation and full refund.

Refund requests outside the cancellation window

Outside the 14-day statutory cancellation window, and where access has been granted, refunds are considered at my sole discretion. Requests should be sent to [email protected] with a description of the issue encountered.

I reserve the right to decline a refund request if there is evidence of misuse or breach of these Terms.

6. Intellectual Property

All intellectual property rights in ELOS Consulting Products and their Content belong to Virginie Ferguson trading as ELOS Consulting.

Upon purchase, you are granted a limited, personal, non-exclusive, non-transferable licence to access and use the Content for your own business purposes. This licence does not permit you to:

• Copy, reproduce, distribute, or share the Content (or any part of it) with any third party.

• Resell, sublicence, or incorporate the Content into any product or service you offer to others.

• Use the Content in any way that misrepresents its origin or infringes my intellectual property rights.

If you wish to use any Product or Content in a commercial context beyond your own business — for example, as part of a coaching programme or course you offer to clients — please contact me at [email protected] to discuss a commercial arrangement before doing so.

7. Limitation of Liability

I take care to ensure all Products are accurate, functional, and of a reasonable standard. However, I do not guarantee any specific outcome or result from use of any Product. Your results will depend on your own efforts, your individual circumstances, and factors outside my control.

To the fullest extent permitted by law, my liability to you in connection with any Product is limited to the amount you paid for that Product.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be limited or excluded.

8. No Guarantee of Results

ELOS Consulting Products are designed to support and guide your thinking and business development. They do not guarantee specific commercial outcomes, client acquisition, revenue, or business growth. Any examples of results achieved by other users are illustrative only and are not a guarantee that you will achieve similar results.

9. Privacy

Any personal information you provide when purchasing or using a Product will be handled in accordance with my Privacy Policy, available at elosconsulting.co.uk. I will not share your personal data with third parties except as required to deliver the Product (for example, the platform provider) or as required by law.

10. Website and Platform

While I take reasonable steps to ensure the website and any delivery platform are available and free from errors, I cannot guarantee uninterrupted access. Scheduled maintenance, technical issues, or matters outside my control may affect availability. I will aim to notify you of any significant planned downtime.

You are responsible for ensuring you have a suitable device and internet connection to access any Product. I am not liable for any damage to your device arising from use of the website or platform, except where caused by my negligence.

11. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of Scotland. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Scottish courts.

12. Changes to These Terms

I reserve the right to update these Terms and Conditions from time to time. The version in force at the time of your purchase is the version that applies to that purchase. Updated Terms will be published on the website.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms and Conditions constitute the entire agreement between us regarding your purchase of any ELOS Consulting digital product and supersede any prior communications or understandings, whether written or oral.
